1. INTRODUCTION AND TERMINATION
The present Terms of Use apply to all services and products and govern the commercial relationship between the seller and services provider Claire Margery, owner of the website www.energyclaire.com, and the client or buyer who proceeds to the purchase of services and products from Energyclaire.
Claire Margery's services and products are reserved to persons aged 18 or over.
2. GENERAL PROVISIONS
These Terms of Use determine the rights and obligations of the parties regarding the online purchase of services and products offered by the seller. They apply for all services and products offered by the seller, Claire Margery through the website www.energyclaire.com
The seller reserves the right to modify the present Terms of Use. The applicable Terms of Use are those applying as of the purchase order.
The order placed by the client/buyer through the website www.energyclaire.com entails his full acceptance of the present Terms of Use, in their entirety and without reservation.
3. PRICE
All the prices for services and products offered by Claire Margery through the website www.energyclaire.com are quoted in Euro.
Claire Margery's business benefits from the VAT "base exemption" regime, (article 293 B of the French General Tax Code). Invoices will be established taxes free.
Claire Margery, owner of the website www.energyclaire.com reserves the right to modify the pricing of her services and products at any time. The applicable price is the one current in the date of the purchase order.
4. DESCRIPTION OF SERVICES
The services and products offered by the seller Claire Margery are listed on the website www.energyclaire.com, exclusive property of Claire Margery.

5. ORDERS
The client/buyer must follow specific steps required to finalize the order. The client/buyer will receive, after placing an order through the website www.energyclaire.com, a confirmation by email of his order.
The seller Claire Margery reserves the right to refuse an order for any legitimate reason.
6. ORDERS VALIDATION AND PAYMENT MODALITIES
The validation of the order placed on the website www.energyclaire.com entails full acceptance of the present Terms of Use, in their entirety and without reservation.
Payment is due at the time of the order. Payment is done by credit card or Paypal account. Secured online payment is ensured by the Paypal company.
The client/buyer will receive a confirmation of the payment from the seller and from the PayPal company.
Once the payment is confirmed, the sale's contract is considered final.
7. CANCELLATION POLICY
The client/buyer has 14 days to use his right of cancellation from the date of the order (article L121-21-8 of the french consumer code) without having any justification to give nor penalty to pay. The cancellation right can be used by sending an email to contact@energyclaire.com compulsorily mentioning the cancellation right in the mail's object.
Refund will be made within 15 days from the day of the session's booking, given the time for bank transfer.
The cancellation right does not apply when the session, ordered and paid and whose date of execution has been validated by both parties, has been fully executed before the end of the cancellation right's period. In that case, by accepting an execution date of the session prior to the end of the cancellation right's legal period, the client/buyer renounces to use this right. (Article L121-21-8 French consumer code)
The purchases of digital healing program files are not subject to this cancellation right. They cannot be exchanged nor refunded. However, despite taking all possible care to ensure the quality of the digital files, if some default prevented the buyer from properly using the downloaded digital files, the buyer will have to send within two weeks following the receiving of the digital contents order, an email containing the defective files to contact@energyclaire.com and will receive by contact@energyclaire.com new repaired digital files. The buyer benefits this way from the warranty against latent defects.
8. REFUND POLICIY
No refund available outside the cancellation policy.
9. LIABILITY
The seller Claire Margery is only bound to an obligation of diligence (utilization of her energetic healing skills and techniques, utilization of her distant connection gift, utilization of her therapeutic tools, etc…) not an obligation of result. She accepts no liability for any damage resulting from her practice.
Claire Margery’s spiritual healing sessions are not offered as a substitute for professional medical or mental health.
10. COPYRIGHT
The Site and its original content, features, and functionality are owned by Claire Margery. All copyright, trademark, patent, trade secret, articles, videos and any other intellectual property are exclusive property of Claire Margery.
Any complete or partial reproduction, modification or utilization without the express written consent of Claire Margery of these contents is strictly forbidden.
11. PERSONAL DATA
All information regarding the client/buyer is subject to the provisions of the law N°78-17 of the 6 january 1978 (data protection act)
Personal data of the client/buyer will be archived for the sake of administration management.
The seller Claire Margery will not share personal information with any other third parties.
12. GOVERNING LAW
These Terms and conditions shall be governed by and construed in accordance with French Law. The parties submit to the exclusive jurisdiction of the french courts to resolve any contractual dispute.
